In our new Legislative Brief, entitled “DOL Clarifies FMLA Rights for Same-Sex Spouses”, we provide an overview of the information that was released by the Department of Labor on August 9th. The DOL confirmed that, for purposes of the FMLA, the term “spouse” includes a same-sex spouse if the marriage is recognized under the laws of the state in which the employee resides.
