Earlier this summer, the U.S. Supreme Court struck down a portion of the federal Defense of Marriage Act (DOMA) by ruling that it violates the U.S. Constitution’s guarantee of equal protection.
As a result of the Supreme Court’s ruling, same-sex couples that are legally married under state law are now entitled to the same benefits and protections under federal law as opposite-sex married couples.

Information from Blue Cross Blue Shield of Massachusetts
Blue Cross Blue Shield of Massachusetts will offer an Open Enrollment period for same-sex spouses through September 26, 2013. The effective date will be at the employer’s discretion, within that timeframe. During the special Open Enrollment period, same-sex spouses and their dependents, who are not already enrolled in their spouse’s current policy, can be added to it. Please note that standard rules regarding dependent coverage continue to apply.
Information from Tufts Health Plan
Tufts Health Plan is offering employer groups the opportunity to hold a special open enrollment until October 1, 2013. An employer group must notify its Tufts Health Plan Account Manager of their intent to offer a special open enrollment period as well as the effective date of coverage. During this special open enrollment period, same-sex spouses and their dependents that are not already enrolled in the subscriber’s plan may be added.
